Franchise & income tax

New York taxes corporations under Article 9-A (the corporate franchise tax). Partnerships and LLCs file information returns and pay a filing fee, and owners pay personal income tax.

Tax is the highest of the business income base, the capital base or a fixed dollar minimum of $25 to $200,000 depending on New York receipts. The business income rate is 6.5%, or 7.25% when business income exceeds $5 million (tax years 2021–2026). A 30% MTA surcharge applies to business in the Metropolitan Commuter Transportation District.
